Individuals with Disabilities Education Act

The Individuals with Disabilities Education Act, previously known as the Education for All Handicapped Children Act, seeks to ensure that all children with disabilities are afforded the same educational opportunities as those without disabilities. Key elements of the law include the Individualized Education Program (IEP), Free and Appropriate Public Education (FAPE), Least Restrictive Environment (LRE), Appropriate Evaluation, Parent and Teacher Participation, and Procedural Safeguards. Schools are required to develop an individualized education program that addresses the child’s unique needs in the least restrictive environment possible. (United States Department of Education, Office for Civil Rights, 2010). The team that works to develop the plan must include the child’s parents, one of the child’s teachers, a professional who can interpret the educational implications of the evaluations that have been conducted, and an administrator or Committee of Special Education that has adequate knowledge of the resources available in the school district and is empowered to commit the provision of those services to the child. Not infrequently, a school social worker will participate in the formulation of an individualized education program.
